Richard E. Hall
Richard E. Hall is a graduate of Harvard Law School, Class of 1969. He previously obtained his Bachelor of Arts from the University of Idaho in 1966, Cum Laude. Mr. Hall is an experienced and effective civil trial lawyer. He is licensed in the State of Idaho, as well as the State of Washington, and has tried cases in both states. Recognition of his level of competency and esteem within the profession occurred in 1991 when he was honored by election as a Fellow in the American College of Trial Lawyers. Mr. Hall has also been selected by his peers for inclusion in "The Best Lawyers In America" every year since 1993, and has been named the “Boise Best Lawyers Personal Injury Litigator of the Year” for 2010.
While Mr. Hall is widely recognized as an experienced medical malpractice defense trial lawyer, he has also defended insurance coverage and alleged bad faith cases, commercial fraud cases, lender liability cases, legal and architectural malpractice cases, automobile cases, drug product and medical device liability cases, engineering and construction cases, toxic tort, corporate director and officer liability, stock broker liability cases and a variety of other very significant damage catastrophic exposure cases.
He is an "A" rated attorney in Martindale Hubbell. He has also served as President of the American Board of Trial Advocates, Idaho Chapter, and as President of the Idaho Association of Defense Counsel. He is admitted to practice law in the states of Idaho and Washington, as well as the U.S. Court of Appeals for the Ninth Circuit.
Twenty-five out of Mr. Hall's last 27 trials have resulted in zero verdicts for his defendant clients. These cases included defense of four brain damaged baby cases, four wrongful death cases, and other serious injury cases. His trial record reflects 45 wins and only four losses. He also has an extensive appellate practice, including the following recent Idaho Supreme Court opinions: Swallow v. Blahd, 138 Idaho 589, 67 P.3d 68 (2003); Dulaney v. St. Alphonsus, et al., 137 Idaho 160, 45 P.3d 816 (2002); Rudd v. Merritt, 138 Idaho 526, 66 P.3d 230 (2003); and Lovey v. Regence BlueShield of Idaho, 139 Idaho 37, 72 P.3d 877 (2003). Mr. Hall’s clients prevailed in each of those decisions.
In June 2005, Mr. Hall successfully defended a product case involving the alleged failure of a medical device manufactured by Synthes Corporation. In 2007, Mr. Hall successfully defended a physician accused of damaging a nerve during surgery (now on appeal). In December 2008, Mr. Hall successfully defended a law firm that was accused of violating legal ethics by allegedly disclosing confidential client information.
He is currently a member of the Federation of Defense and Corporate Counsel (“FDCC”), which is an international organization of defense attorneys. He was elected to the Board of Directors of that organization and served as a member of the Executive Committee as well as the Chair of the Corporate Counsel Initiative Committee. Mr. Hall also served nationally as the former Chairman of the Medical Malpractice Section.
Mr. Hall has appeared on numerous topical legal programs, both locally and nationally. In 1992, he participated in the presentation of mock final arguments in a demonstration of trial techniques in brain damaged baby cases at Boca Raton, Florida. His opposition in that mock trial demonstration was Tom Demetrio of the Corboy and Demetrio firm of Chicago, Illinois. In 1994, he spoke at Chateau Whistler Resort in Whistler, British Columbia, on the topic of "Defending Against Enhanced Injury Cases." In 1996, Mr. Hall participated in a program in London, England, demonstrating the techniques of cross-examination of expert witnesses and, as part of that program, cross-examined the head of the Department of Urology from Harvard Medical School. Mr. Hall has participated in several all-day trial tactic seminars and programs on topics relevant to trial practice and damages. Mr. Hall has presented several programs to the Idaho State Bar on legal malpractice and trial practice.
Mr. Hall is the author of several medical/legal articles. He has served as a member of the Medical Advisory Board for Physicians Management magazine, in which he has published three articles on the topic of malpractice avoidance. He is the author of "Using Improvements in Medical Technology to Prove Timing of Newborn Brain Injury," Federation of Insurance and Corporate Counsel Quarterly, 1991, and is co-author of "Medical Malpractice in Idaho: An Update," 23 Idaho Law Review, 1987.
Mr. Hall has served as President of Hillcrest Country Club, President of Rotary Club of Boise Southwest, and currently serves as Chairman of the Board of United Heritage Mutual Holding Company, United Heritage Financial Group, Inc. and United Heritage Life Insurance Company. Mr. Hall served on the Advisory Board of the Boise Metropolitan Chamber of Commerce, as well as the Boards of the Arid Club, Junior Achievement of Idaho and the Family Practice Residency of Idaho. Currently, Mr. Hall serves as a board member of the Idaho Shakespeare Festival theater.
Mr. Hall is proud to be one of the founding partners of Hall, Farley, Oberrecht & Blanton, P.A. Rich and his wife, Tonya, have four daughters—Christine, Tara, Michelle and Erin. They also now have five grandchildren.
