Complex
Litigation
The reputation of our firm is best exemplified
by our strength and experience in complex litigation. Positive
results, commitment, and careful case preparation are among
the reasons why we receive many business, professional
liability, and personal injury case referrals.
Our lawyers appear before all Idaho state and
federal trial courts, and our experience includes the trial
and favorable resolution of the following types of litigation:
aviation and product liability; general tort law; professional
liability defense; environmental and occupational claims;
insurance coverage and insurance defense; real estate
disputes; contract; construction; lender liability defense;
securities; surety; and appellate practice.
Construction
Litigation
Our firm represents a large number of
general contractors, subcontractors, and suppliers to the
construction industry as well as owners, developers, and
operators of real estate projects. The lawyers involved in
construction litigation handle all types of construction
disputes, in both the private and public sectors. They
practice in state and federal courts, in the United States
Court of Federal Claims, before various federal boards of
contract appeals, and in arbitrations and mediations. Specific
services available include the defense and prosecution of
claims relating to breach of contract; changes to contract
requirements; breach of warranty; defective specifications;
differing site conditions; delays; misrepresentation;
negligence; fraud; bidding process irregularities; mechanics’
and materialmens’ liens; and payment and performance bonds.
Commercial
Litigation
Our commercial litigators counsel clients
in virtually all forms of business and self-insured disputes,
including tax, breach of contract, lender liability,
antitrust, labor law, employee relations, commercial paper,
secured transactions, banking, securities, bankruptcy, real
estate and land use, RICO, trade secrets, and stockholder
actions.
Alternative
Dispute Resolution
Although we
are experienced litigators, our trial lawyers frequently
negotiate, mediate, arbitrate and seek alternative solutions
to legal disputes outside of the courtroom. Although trial may
be the appropriate dispute resolution for some cases, our
lawyers are skilled in alternative and innovative methods for
successful resolution of disputes. Also, one of our
experienced litigators has successfully completed a 40-hour
course necessary to serve as a third-party neutral. Many of
our experienced litigators are called upon to serve as hearing
officers or arbitrators.
Professional
Liability
Hall Farley has established a long-term and
highly successful involvement in professional liability
matters. We provide legal representation of insurance
carriers, third party administrators, self-insureds and
professionals from a variety of fields of endeavor. Our
attorneys contribute services from risk management and
avoidance through jury trials and appeals. The firm’s
services have benefited physicians, accountants, architects,
attorneys, podiatrists, veterinarians and engineers, as well
as corporate directors and officers, business executives,
financial planners, investment advisors, real estate and
insurance brokers/agents. Our trial record and the reputation
that flows from winning jury trials in the defense of
professional malpractice matters is one of our strongest
assets.
Due to our widespread professional
liability practice and experience, our attorneys are often
asked to lecture other attorneys and other professionals on
professional malpractice topics and those lectures have
stretched from London, England to Whistler, British Columbia,
Canada to Boca Raton, Florida. One of our attorneys served as
the national chairperson for the Medical Malpractice Committee
of the Federation of Defense and Corporate Counsel. We are
also active in the International Association of Defense
Counsel, the Tort and Insurance Sections of the American Bar
Association and DRI.
Hall Farley is proud of its professional
liability experience and expertise and is ready to anticipate,
address and litigate whenever new malpractice problems may
arise in the 21st century.
Business
Law
Our business lawyers assist with the legal
issues encountered by all businesses, large and small. They
are experienced in the structure and negotiation of a number
of business transactions including the maintenance and sale of
partnerships, corporations, and professional service
corporations; state and federal taxation; real estate;
antitrust and trade regulations; environmental law; and
municipal law. Expertise is also offered in the areas of
bankruptcy; employment and labor law; pension and profit
sharing plans; franchising; creditor's rights; and
intellectual property rights.
Insurance
Hall Farley has enjoyed a long and varied
association with and representation of insurance carriers. The
management of insured risk through competent, experienced and
successful trial attorneys defending insureds, self-insureds
and third party administrators is one of our firm’s primary
focuses. Our insurance practice covers nearly every type of
insurance claim, including defense of coverage and bad faith
claims, and we have tried insurance-related cases throughout
all corners of the state of Idaho. We provide counseling in
the management of insurance claims and our stable of
successful experienced trial lawyers is always ready to go to
trial when necessary. We also use alternative dispute
resolution when and where that is appropriate. The companies
we represent insure medical malpractice, legal malpractice,
transportation, automobiles, employment, accountant,
architectural and engineering malpractice, governmental, and
all other types of available insurance. We are extremely proud
of our insurance defense practice. Some of the companies we
have represented have been with us for over 25 years. We will
continue to strive to maintain an excellent, effective and
successful relationship with all our insurance carrier
clients, built upon experience, ingenious problem solving,
early case evaluation and thorough trial preparation.
If you are in the insurance industry and have
business anywhere in the state of Idaho, Hall Farley is here
to help.
Employment
& Labor Law
Our lawyers
involved in labor and employment law address issues related to
the employment relationship, including administrative and
judicial proceedings for the defense of wrongful discharge,
discrimination, harassment, civil rights, unemployment
compensation, and wage and hour claims. Our employment law
practice also includes advice for OFCCP, wage and hour claims,
and other employment practice audits. Our labor attorneys also
represent clients in arbitrations, labor negotiations, and all
types of National Labor Relations Board proceedings. Although
a significant number of employment matters are litigated, our
lawyers provide counsel and training to clients on personnel
policies to avoid potential or future litigation and assist
with human resource management. Some of the services available
include assisting clients with the development of employee
handbooks, drug and alcohol testing programs, and preparing
and updating retirement plans and compensation plans to ensure
compliance with the Internal Revenue Code and ERISA. The
distribution of our firm's quarterly newsletter, Employment
Law Update, is another service offered in an effort to keep
clients abreast of continuing changes and developments in
employment law.
Real
Estate, Estate Planning & Probate
The estate planning services offered by our
firm cover all facets of estate preservation and distribution.
With the constant change in tax laws, the buildup of estate
values, and the aging of our country's population, our lawyers
have developed a wide range of estate planning alternatives.
They provide counsel on matters such as family trust
arrangements and charitable giving, in addition to
facilitating the probate and administration of estates. Our
real estate practice covers a variety of transactions,
including the purchase, sale, and zoning of property and the
assessment of environmental ramifications related to
subdivision, commercial, and industrial developments.
Health
Care
Our firm’s extensive health care practice
includes the representation of physicians, hospitals, nursing
homes, and other health care personnel and entities in the
defense of medical malpractice claims. In addition, we
actively advise our varied health care clients regarding
corporate compliance plans, fraud and abuse, Medicare and
Medicaid audit defense, Stark and False Claims Act concerns,
risk management issues, physician-hospital contracting,
managed care agreements, reimbursement issues, patient
confidentiality and record keeping concerns, antitrust,
medical staff issues, tax exempt status issues, and a variety
of other health care matters. Our health care attorneys
include members of the American Bar Association, including the
ABA’s Health Care Law Section, its Litigation Section, and
its Tort & Insurance Practice Section; the American Health
Lawyers Association, including its Fraud & Abuse Committee
and its Healthcare Liability and Litigation Committee who are
frequent lecturers at continuing legal and medical education
seminars, risk-loss prevention discussions, and other programs
addressing a vast array of medical/legal issues. We are proud
of our reputation as a leader in the representation of health
care providers and related entities.
